assistir a show dos Guns n’ Roses

F?s que n?o puderam assistir ao show da banda Guns n’ Roses, pois n?o receberam os ingressos em casa, como solicitado no momento da compra, s?o indenizados. A 1? Turma Recursal C?vel do Estado do Rio Grande do Sul manteve a condena??o da T4F Entretenimento S/A ao pagamento de indeniza??o por danos materiais no valor de R$ 394,00 e de R$ 3 mil por danos morais.

Caso

Os autores, dois f?s do grupo de rock, adquiriram ingressos para o show que a banda fez em 16/3/2010, em Porto Alegre, pela internet. No momento da compra, optaram pela entrega a domic?lio via sedex, uma vez que residiam no munic?pio ga?cho de Caxias do Sul. Os tickets, por?m, n?o foram entregues.

De acordo com a r?, T4F Entretenimento S/A, o endere?o informado era insuficiente. Segundo o e-mail de confirma??o de compra enviado aos autores, contudo, caso houvesse algum campo em branco ou incompleto, a aquisi??o poderia ser cancelada e, se necess?rio, a empresa entraria em contato.

Decorrido o prazo para a entrega sem que os autores tivessem sido informados da situa??o, eles decidiram contatar a r?, momento em que foram comunicados da falta de tempo h?bil para entrega dos tickets. Os autores, ent?o, pediram o cancelamento da compra. Como a solicita??o n?o foi confirmada, eles decidiram se deslocar at? Porto Alegre na expectativa de retirar os ingressos no guich? do evento. Por?m, ao chegarem no local  do evento, foram informados de que n?o havia reserva em seus nomes. A r? alegou que os ingressos n?o estavam dispon?veis no guich? devido ao cancelamento da compra.

Em primeira inst?ncia, na Comarca de Caxias do Sul, considerou-se que a r? deveria ter entrado em contado com os consumidores t?o logo tivesse conhecimento de que a correspond?ncia n?o havia sido entregue, bem como que havia tempo para retificar o endere?o e encaminhar os ingressos novamente. No hist?rico da correspond?ncia consta que a mesma foi postada em 11/2 e distribu?da ao remetente em 22/2/2010. Ainda, deveria ter formalizado o cancelamento da compra e confirmado junto aos autores.

De acordo com a senten?a, os fatos caracterizaram falha na presta??o do servi?o (artigo 14, caput ? 1?, I e II, do C?digo de Defesa do Consumidor), pois n?o foi fornecida a seguran?a esperada pelo consumidor. Nesse mesmo sentido, o caso configurou descaso com os autores, de modo a atingir a dignidade e a honra dos consumidores.

Logo, ficaram impossibilitados de realizar seu sonho em raz?o da falha do servi?o prestado pela r?, referia a senten?a.

Foi determinado ? T4F o pagamento de indeniza??o por danos materiais fixada em R$ 394,00 e de repara??o por danos morais fixada em R$ 3 mil. A r? recorreu da senten?a.

2? Grau

A 1? Turma Recursal C?vel confirmou a decis?o de primeira inst?ncia. Em seu voto, o relator, Juiz Leandro Raul Klippel, afirmou que restou configurado o desrespeito ? pessoa do consumidor em raz?o da conduta da r?, tornando, dessa forma, poss?vel o acolhimento do pedido indenizat?rio dos danos morais decorrentes da frustra??o, ang?stia e decep??o infligidos aos autores em raz?o da falha na presta??o do servi?o.

Os Ju?zes Heleno Tregnago Saraiva e Ricardo Torres Hermann acompanham o voto do relator.
