Axl Rose has filed a motion to dismiss a sexual assault lawsuit against him.

The Guns N' Roses rocker was sued in November by model Sheila Kennedy, who accused him of sexually assaulting her in a New York City hotel room in 1989.

Rose's legal team have now submitted court documents in an effort to get her case thrown out.

"Kennedy cannot and will not succeed in this unscrupulous attempt at a financial windfall. This lawsuit will lay bare the falsity of these vexatious and meritless allegations," their filing reads, according to People.

In the documents, the 62-year-old's lawyers pointed out that Kennedy described the alleged incident as "consensual sex" in her 2016 memoir No One's Pet. They also argued that she said she "did not consider it rape. It was consensual" in the 2021 documentary Look Away.

They claimed that the former Penthouse pin-up realised she "could profit from claiming that the incident had not in fact been consensual" via New York's Adult Survivors Act, a one-year window that extended the statute of limitations for allegations of sexual misconduct.

In her lawsuit, Kennedy, now 61, claimed Rose "violently" sexually assaulted her in his hotel suite after meeting in a nightclub.

His lawyer denied the allegation back in November.

"Simply put, this incident never happened. Notably, these fictional claims were filed the day before the New York State filing deadline expires," attorney Alan S. Gutman said. "Mr. Rose is confident this case will be resolved in his favour."

Unintended consequences. This is what happens you try to weaponize the courts against political rivals. Other people get caught in the wake. I hope Axl’s lawyers kick her’s to the curb.

Amen! As a woman this kind of thing sickens me! No way in hell I would attempt this kind of action. EVEN IF, it happened as a woman I would have gone to the police or never mentioned it again. Nothing but her word against his.

Anyone have an update on this?

They are still working through Axls motion to dismiss.

Filings were due (and submitted) in May.  Most of them pertain to arguments surrounding Axl's claims of failure to properly serve him legal documents (but not entirely around that).

There's a compliance hearing in late September before the judge.  Probably going over some of the material submitted and to make sure everyone's ready for the actual court date for the motion to dismiss.

Then they have a court date in late October (October 22nd) for the judge to actually hear and possibly rule on the motion to dismiss.

Regardless, and I hate to be the guy griping about the media for a number of reasons, but far too many publications are quick to publish accusations, and slow to report actual outcomes if they don't support the original headlines.

I worked at major newspapers, so something like this would probably be in the entertainment or lifestyle section. The initial lawsuit - depending on the celebrity - might be on the front page of that section. Regardless, the follow-up would be much smaller and more than likely on the inside of that section. There are always exceptions. For example, the Johnny Depp/Amber Heard lawsuit. Axl doesn't have the star power today that he had back in the 80s and 90s, so I'm not surprised a follow-up wasn't done. If this was 1993, then both stories more than likely would be on the front.

Oh I totally get that. I've got some media background myself, hence why I said I didn't want to be the guy griping about media - but at least some of the online publications, where copy space isn't at a premium or even a consideration since it's just a website - you'd think they would follow up. Especially with GN'R announcing a tour. In the end, the L.A. Times and Rolling Stone reported there was a settlement, with Axl's attorney denying the allegations in the story. No settlement details, but I'm assuming it was cheaper than a trial.

Ah gotcha. Haha I remember when every newspaper got a website and we could write as long as we wanted. Nowadays people just read the headlines (which are usually sensationalized) and then start commenting without actually reading the story, which often is quite different. Thanks for the update. I didn't realize there was a settlement, and, yeah, 9 times out of 10, it is cheaper. I'm sure both sides signed an NDA not to talk about it.
