Looking into some of the terms used:

It was Published for Opposition at October 28, 2014. This means that the inquiry has been processed and published in their database. Then, if anyone has an objection to the trademark claim they have 30 days from that date to object.

On December 23, 2014 a Notice of Allowance was issued to Axl. Basically he's got the trademark, but he must still finalize the claim. The category of use is already filed, but I think the final document must include specifics.

So, I had no knowledge of the phrase "Stay of execution" previously, but it seems like this is a term used in the court of law.

Fits with Axl's sense of humor too..

I don't think you trademark song titles.

Doesn't mean there couldn't be a song as well (like on Chinese).

And look at the timing.  Done right at the end of touring, when he was already talking about looking at what they would do going forward.  So we know that's where his head was at.

I like it.

I agree on the timing. It fits nicely ? almost too good to be true.

After doing some more digging on the subject I found this:

Generally speaking, titles of albums and books (as opposed to their content) are not protectable under U.S. copyright law. Titles are typically considered too insubstantial and non-original to garner copyright protection, which is reserved for creative ?works" fixed in a tangible medium of expression.

Similarly, U.S. trademark law does not allow for direct registration of album and book titles as trademarks. However, I say it does not allow for ?direct" registration because, while the title cannot be registered for use on the album or book, it can potentially be registered for use in connection with related merchandise or memorabilia. When a musician or music group has plans to print album-specific t-shirts, or an author has plans to develop a line of action figures for the characters in their book, they can (and should) seek to register their trademarks for use with these items.




So... You can't really trademark an album title directly. The thing you can do is trademark a phrase or name that will be used on merchandise connected to the album. I think that phrase can be the same as the album name, but it won't stop other artists from naming their album the same.

One other possibility is this being a trademark for a music group.




The thing that favor the latter (music group) is the categories that the trademark is filed under.

The first one is the one I mentioned earlier:

Digital media, namely, pre-recorded DVDs, downloadable audio and video recordings, and CDs featuring and promoting music; Pre-recorded CDs, video tapes, laser disks and DVDs featuring music


The second one is:

Entertainment, namely, live performances by a musical band; Providing a website for entertainment purposes featuring videos, photos, news and music about a musical group



So, going by those categories, I lean more towards the name of a band.

So didnt we have this talk a few months ago. 

When the subject of the offspring using CD as the title to there album at the time.  And how Axl couldn't put a copy write on a song or a album......   

So if he couldn't then

I doubt he can now. 

So people.  Don't get any album hopes up over this.

We should ask an expert to have a look, and he/she could probably tell us what it is for, based on categories and classification.

Given the claim isn't finalized I wouldn't expect any official response. This could be something as mundane as the name of the next residency to an album or song name that will be used on a line of merch (and therefore able to be trademarked). That said the only other trademarks Axl has per that site are Guns N' Roses, two of which are live. Take it for what it's worth.
