Sutherland faces 48 days in jail

Having pleaded no contest to drink driving, '24' star Kiefer Sutherland is now facing 48 days in jail as part of his sentencing deal.

Reuters reports that if the sentencing deal is approved by a judge, it would allow Sutherland to serve 18 days in jail in late December and early January and another 30 days when '24' is off the air next summer.

The sentencing deal would not disrupt the filming of the seventh series of '24'.

In a statement about Sutherland's deal, '24's makers Fox said: "He told us that even if he had to sacrifice more time in custody in order to protect the show and the jobs of those who work with him, he would do so. From what occurred today, it is evident he is a man of his word."

Sutherland was arrested last month while still on probation for a 2004 drink driving offence.

Prosecutors have recommended that he serve 30 days for last month's offence and another 18 days for violating his probation in the 2004 case.

The final sentence will be decided by a judge.

Sutherland will be barred from driving before 9 May 2008 and prosecutors have recommended that he be ordered to enrol in an 18-month alcohol education programme and attend weekly counselling sessions on alcohol abuse.

The actor was not in court yesterday; he issued a statement in which he apologised for his "poor judgement" and the "distress this has caused by family, friends and co-workers".

That is a bit harsh for a 2nd DUI isn't it, especially since there was no accident. When he was a teen, everyone drove drunk; kids and older people.

As long as it doesn't effect the production of 24 (it doesn't...he's serving the sentence during the winter production break and next summer)....I good with it.

It's his 2nd DUI (well, not really..more in a sec on that), but he also violated probation...tha'ts why the length of the sentence is a bit longer than you would expect.

Keep in mind, his last DUI was in 1993 so it's not like he's doing this  constantly.

This recent episode WON'T be considered a DUI, either.  That specific charge was actually dropped.  He's pleaing to "Driving with an elevated blood alcohol level" (a 2nd degree misdemeanor) and violating his terms of probation.

Yeah, 25% of all the worlds inmates sits in an American prison. So either you got the most vicious poplace in the world, or people are being thrown in jail for some bullshit.

While I agree that a 2 year sentence is perhaps a bit extreme, to suggest that driving under the influence doesn't warrant any jail time for fear of there being "nobody left" is rather absurd.

Last year in Toronto, 2 teenagers were street racing and ending up killing a cab driver.

Since their parents are filthy rich, both kids got a slap on the wrist.

There is a law for the rich, and a law for the poor.

A law for the cops, and a law for the politicians.

That's my point. Most people drive drunk all the time, regardless of ethnic background, or class. People drive drunk. Some are smashed, some are simply legally drunk. Some get home fine, some kill people, some run their car into a ditch....etc etc.

If you get in your car drunk and hurt somebody than you should be held responsible. But I do not think driving drunk alone is an offense worthy of putting people in jail. It's as simple as that.

If you're driving 90 MPH down the highway, in a 65, weaving in and out of traffic...and you get pulled over, what happens? You'll probaby get a ticket.  You MIGHT get arrested, but you're going to get a slap on the wrist.

I'd call that driving that way a serious and potentially dangerous error in judgment.

If you're driving 90 MPH down the highway, in a 65, weaving in and out of traffic...and you plow into a minivan, injuring or killing somone...what happens?  You'll DEFINITELY get arrested, and you have a pretty good chance of doing jail time (depending on the severity of the injury to those in the other car.

Why is it (or should it be) any different for those caught drinking and driving.  I mean, we're not talking about a habitual act (his last DUI WAS almost 15 years ago) here.  We're talking about someone who makes a really bad judgment call every couple of decades.  I think 6 weeks in jail, or so, is a fitting punishment.
