Jarmo made a good point, i thought, in saying that he wont allow discussion of the material untill it is offcially realeased, which is what the band wants. He also stated nothing was going on back in febuary so that was different. And i aggree with him when he says that. Discussion of live songs is ok and discussion any new leaked material is not ok. With all thats going on and what looks like a single to be released soon and all signs pointing towards the albums release this year, I can live with that.

My guess is Harley has rights to use the song, and in the contract it is not to be "aired" or televised before a given date. However, there is a loophole because nothing is stated relating to a date for posting the ad online. Merck & GnR really don't have a case regarding pulling the spot from the website since contractually they have the rights to do so with the song.

I would hope not, this is nothing but good publicity for the band. ?Pulling things now is just going to anger people and make the band look flakey. ?This can do nothing but generate more interest in the new so I can't see how it would make any sense to turn back now.

I've heard (not sure how true it is) that Merck is attempting to shut Sp!at and MyGNR down over this.
If it is true, it's obvious he's got jarmo over a barrel.  I don't know what Merck's hoping to achieve with all this, but if it's to piss what fans the band have left off, he's doing an incredible job.

Where did you hear that from? Was it from those sites mentioned. Sonds like an exageration by whoever you heard it from to make said sites sound like sites "of the people for the people".
