to my knowlege the only way they could keep the name Chinese Democracy and even have a chance to stop Axl from using it is if they make it big (like mainstream big) and keep it long enough without complaints. (im not sure on the timescale) but this happened with Nirvana, a band tried to claim Nirvana was their name and they couldnt do jack about it because they had been mainstream for (say) 2 years, and they didnt say anything about it before.

You can't copyright or trademark an album title or song title.

how did axl stop the offspring using chinese democracy as an album title ?

He didn't stop them - Offspring later admitted in an interview that they weren't serious about using the album title.

but didnt he send them a cease and desist letter? yes

Sure - but GNR's lawyers would probably throw a shitfit saying that the release would hurt Guns N' Roses album sales. But since it's Kitty and the Kowalskis and not a mainstream band like Offspring, they probably wouldn't care.

Again, you can't copyright or trademark a song title or album title. You can copyright the composition of music and lyrics, but not the title.

kitty and the kowalskis are desperate. they used to be called killer kowalski, a name robbed from the old wrestler until he threatened to sue and they changed it. then they rob guns n roses album title, and isnt the lead singer called KITTY KOWALSKI the name of a character from superman ? does this band do ANYTHING ORIGINAL?  drool

Like I just said in another thread, Axl's lawyers didnt send a cease and desist letter to the Offspring. The singer admitted it was bullshit, he never heard from Axl or his lawyers.

people like the dogshit boys and kitty and the kowankskis dont bother me because they only have about 5 fans between them. but if the rumour on the blind melon forum is true that the reformed blind melon are plannin on callin there comback album chinese democracy, that is quite a concern. blind melon are a big band and if people started to associate the title with them then the mainstream would be very confused when gnr eventually release theres.  no
