Good question, Neemo.  Again, I think that Merck and the gang are making the best of a bad situation here.  "Yes, WAAF, go ahead and play IRS (which has been played before by Trunk so it does technically fall under 'fair use' I believe) but don't play Better / T.W.A.T. and we'll, you know, look the other way"

Thats pure speculation on my part, though.

Why are some people in this thread acting like there's a possibility these songs haven't been copyrighted? Even amateurs have their lyrics and books copyrighted.

Hmmmm, I don't see anyone having said that anywhere.

I've said the radio stations are within their rights to "play dumb" after receiving a C&D, and can ask copies of the actual legal docs showing a copyright exists....because, as yet, there is nothing in the public domain that would show that copyright.


Legally, copyright exists as soon as you write it.? There's no process you have to go through to prove it (like patenting).

I thought their had to be some legal corroboration, especially for music?  I'll hunt around to double check, though.

I don;t want them to play TWAT, IRS, or the half of Better. It doesn't represent guns in current state or form wouldn't we agree (demo's 2002/2004)? + the quality is bad and doesn't live up to CD/studio version anno 2006

Get over it, this is creating a buzz that they havent felt since 2002. They are getting postitive feedback, and free pub. Whats the problem.

I checked.  While the copyright does exist at authorship, it is generally considered good legal precedent to Register the Copyright with the LOC (in the US) because it provides you with increased legal protection against and for suits to defend the copyright.

As someone who's actually heard them play IRS three times now (over the stream, anyway) I can say that, it actually sounds 'smoother' when they play it when I do off of a CD.  I'm guessing the compression has helped take some of the shrillnesss away fom the track.

It sounded "cleaner" when I heard it on my local station too, so you must be right. cuz I know for a fact that they have the leaked version we do.

Ok, i'm sorry, but this is such a fucking set up.

WAAF is going to play IRS again soon (as in, a few minutes, apparently) - the DJ goes "Coming up soon, and i mean really soon, the new Guns n' Roses song.. we've been playing it all weekend long.  Their lawyers have been trying to use their battering ram to break down the door outside"

Come on, you mean to tell me WAAF is going to sit there and fucking TAUNT a bunch of attorneys?  No way in hell. Sorry, I just can't believe it.

Negatory.  The first thing counsel would tell you is "shut your fucking mouth" in a situation like this.  Attorneys don't say "hey, go out there like the schoolyard bully and throw sand in Bobby's face!!" - This is the real world, with real money and real consequences.

Also, look at the ratings boost for this radio station if they are sued/threatened by Axl's lawyers.
