sorry ebay isn't one of my strengths but even if the guy doesn't pay you the 11million do you still have to pay ebay the $165,000+?

Yes because until the seller goes through the proper routes to take care of the unpaid item, he is still liable to ebay because it is a binding agreement between the seller and ebay also.  That's how ebay makes money, you have to pay them to sell your stuff.  They get a percentage of your final selling fee. It's like 10% I believe.
