The fact that the songs were released so close to each other, time wise, and the fact that the bands were similar is also evidence. It's kind of like how Kiss stole the Dictator's song The Minnesota Strip to make War Machine. Both bands are from New York, and the songs came out about the same time, and the same style, suggests a rip off.
If two similar songs are highly separated by genres, time, location, etc, then it could just be a coincidence. There is just too many similarities in the two examples I gave for it to just a coincidence, though. It's not just the opening riff of Get Stoned; it's also the second part of it, and the drumming as well.
