Title: Use your illusion III
Post by: Fuckin' Gunner on July 10, 2004, 06:48:30 PM
Maybe I'm saying shit, don't know exactly, but Amazon is listing an album called 'Use Your Illusion III' to an Ag]ugust release.

http://www.amazon.com/exec/obidos/tg/detail/-/B0002IQA72/qid=1089497605/sr=1-6/ref=sr_1_6/104-0860850-9899115?v=glance&s=music

If it's old really sorry, I'm not sure WFT is this.

The band name is also listed: Treephort.

Apparently they released an album called Kill Em All in 2003.  ::)

Maybe, they just like to use other artists' album titles to attract fans and gather sales.

When I followed the link, the image was no longer available.  If the above image that was posted is the one they had...watch out Treephort.  :hihi:

I wonder if Axl and his team of lawyers know about this?  I'm sure that if they did, they'd do something about it...they sued the company that put out the Hollywood Rose cd.  Then again, maybe they are now gun-shy since they lost that injunction/case.   :-\    I didn't understand all of the legal mumbo jumbo from that (Hollywood Rose) case, but seems like this...  if the cover art, title, etc would confuse the consumer, they'd have a case.  (or did I totally misunderstand the court document?)

Using that cover is a poor attempt at humour

I hope Axl sues them for all ?13:57 that they are worth

I thought someone couldn't copyright an album title.

IE how that band last year said they were gonna name their new cd CHinese Democracy since Axl stole the dreads look from them.

Taking a Title is ok, like stated before as long as your album cant be confused with the original artist that is why so many country artist have an album called "Home"

What the fuck? Can't people think up original titles these days?Anyway,I think when I record my next album I will call it Appetite For Destruction II,I'm joking ofcourse ;),that's sick.

You're right, John Deacon.  Album titles can't be copyrighted.  I was talking about how similar the cover art is along with the title.    It's already confused at least one consumer (Fuckin' Gunner that started this thread).  :hihi:

Yeah some people cant write music, so they rip off other artist and use it as free publicity. I BET THAT BAND IS HOPING AXL SUES THEM SO THE LAWSUIT CAN AND WILL GIVE THAT SHITTY BAND FREE PUBLICITY and help sell their shitty album. Maybe if it was called UYI 3 it could be kind of funny and respectful to the artist, but to Have a very similar cover, very similar album name THATS JUST LOW.

Shame on you Assfuckers, who ever the hell the band is I wont waste 1 cent or 1 second regonising your band

I saw this CD in the store. It's hard to see on the pic here, but the guy in the backround is holding a bottle of booze.

I dont think so,  because we have not heard of anything from axl's lawyers sueing or taking some form of legal action against these people, but then again they could not give a flying rats arse

The cd has been out since June, so I am sure Axl would of sued back then to stop it, I think he has a legal right to sue, because its ok to use a album's title for your own as long as someone wont confuse it with the original, since that album looks so much like a GnR album I think Axl has some ground

Title: Re: Use Your Illusion 3?
Post by: O'Reily on August 20, 2004, 07:59:34 AM
The album cover/name is clearly a parody as such Axl has no right to sue.

Hee hee! The little fella's lighting his fart on fire... Maybe the blue flame could be the backdrop colour for Use Your Illusion IV?   :hihi:

They probably can't do sh*t.
The artwork isn't owned by Axl, is it?
Like Appetite for Destruction, GnR took the name Use Your Illusion from this very
painting. My memory might fail me, but if this is true, then...I don't think they
can do anything if the original artist sold them the license to use it.
Regardless, who cares. nobody knows who the hell this band is anyway.

You can't sue over a parody.

I think parodies should be free game.
But, that said, didn't Eminem actually stop Weird Al's parody video of him?

buying a painting doesn't mean you own the copyright. He could have bought the copyright but I highly doubt it.
Either way it doesn't matter legally speaking Axl/whoever owns the rights to the painting can not do shit about it because it is a parody

cant they get sued for using that cover

No, they can't. GNR don't hold the copyright to that image. It's an excerpt from a painting by a famous painter. I forgot which one. And they don't hold the copyright to the font either so that's also something they can't sue about. And the style is coprighted by the design company who designed the artwork for GNR. So in the end they don't have anything to sue about....
